Terms & Conditions

 

By enrolling your child at WestEnd Flamingo, you accept these terms and conditions ("Terms & Conditions") and sign your agreement to them as an ongoing agreement between you and WestEnd Flamingo ("Agreement").

The Agreement is made between the parent/guardian ("Parent", "you" or "your") of each enrolled student ("Student") by a Parent and WestEnd Flamingo Limited ("WestEnd Flamingo", "we", "our", "us") (trading as WestEnd Flamingo) and is valid at all times whilst the Student is enrolled on any WestEnd Flamingo activity and until such time as written notice is given in accordance with these Terms & Conditions.


 

1. INTRODUCTION
 

1.1 These Terms & Conditions apply to all our WestEnd Flamingo schools, Courses, Holiday Workshops/Camps, Workshops and any additional products and/or services offered by WestEnd Flamingo and/or its group of companies in the future for any Student (collectively "WestEnd Flamingo Activities")
 

1.2 For participation of a Student in a WestEnd Flamingo Activity all Parents are required to consent to these Terms & Conditions by signature or by ticking the acceptance box for these Terms & Conditions when submitting an electronic application form online. We may update these Terms & Conditions from time to time.
 

1.3 Any changes to these Terms & Conditions require the written consent or approval of WestEnd Flamingo.
 

1.4 A "Course" refers to a course of classes offering tuition in performing and creative arts, which will be delivered during the Term (including online activities). Course classes will take place once per week for a certain number of hours, as detailed at the time of booking.
 

1.5 "Holiday Workshop/Camp" refers to Workshops (including online activities) run by some WestEnd Flamingo schools and WestEnd Flamingo during the breaks between Terms.
 

1.6 "Principal" refers to the principal of a particular WestEnd Flamingo school.
 

1.7 "Term" refers to one normal academic term of WestEnd Flamingo schools during which Courses are run.
 

1.8 "Term Dates" refers to the dates for the relevant Term.
 

1.9  "Workshop" refers to a one-off course (including online activities) offering tuition in dance, drama, singing and/or other performing arts related activities which will be delivered for a certain number of hours per day for a period of between one (1) and five (5) consecutive days and can run at any time throughout the year.

1.10 “Online activity” refers to online streamed lessons and online Workshops utilising the Zoom platform, either delivered by a WestEnd Flamingo school or by WestEnd Flamingo.  See section point 8.7.
 

2. ENROLLING A NEW STUDENT IN A WESTEND FLAMINGO ACTIVITY
 

2.1 To apply for a place for a new Student on a WestEnd Flamingo activity, the Parent or adult must agree to these Terms & Conditions and submit an application form online.
 

2.2 Each Student's place is allocated on a 'first come, first served' basis. Applications must be accompanied by the appropriate payment/transfer, as set out for each WestEnd Flamingo Activity below ("Deposit").
 

  The Deposit to accompany a new Student's application form for term enrolment is the full fee.

  For Holiday Workshops and Summer Camps, deposits may vary, please check on our website.
 

2.3 If WestEnd Flamingo is unable to accept the Student due to capacity reasons, the Student may, at the Parent's discretion, be placed on a reserve list.  
 

2.4 Times, current Term Dates, fees and all relevant course details for booked WestEnd Flamingo Activities will be confirmed after “Checkout” for each WestEnd Flamingo Activity, along with a confirmation email of payment.
 

2.5 All such terms and conditions detailed in the confirmation email shall be incorporated into the Agreement and shall be deemed to have been accepted by an adult or the Parent upon payment by, or on behalf of, the Parent.

2.6 Fees for WestEnd Flamingo Activities may vary between WestEnd Flamingo schools.
 

3. BALANCE PAYMENTS
 

3.1 Fees are paid in advance per term to secure your place. You are obliged to pay the full amount charged for the Tuition Fees. For a Student enrolled on either a Course or Holiday Workshop/Camp, the full fees are paid as the Deposit in advance, as detailed in clause 2.2 above.
 

1. Bank transfer;
2. Credit card (American Express is not accepted);
3. Debit card;
4. Cheque;
5. Direct Debit;
6. Cash;
 

3.4 Transaction charges apply to cheques of £2 per cheque.

4. COURSES
 

4.1 A WestEnd Flamingo school may, at its discretion, offer the second child of the same family attending a course at the same time, a sibling discount of up to fifty percent (50%) on Course fees. This discretionary sibling discount will only apply if WestEnd Flamingo is notified of the sibling relationship at the time of enrolling the student. Only one discount may apply against the Course fee for an individual child at any one time.
 

4.2 Once enrolled on a Course, Term Dates for the next Term will be made known to Parents in writing at the end of the current Term.
 

4.3 If a Course session falls on a bank holiday then a replacement class will also be added onto the end of the current Term timetable or the subsequent Term.
 

4.4 Unless WestEnd Flamingo is otherwise notified in writing by you before the sixth (6th) week of the Course, a Student is automatically re-enrolled onto the Course for the following Term.
 

4.5 If you do not notify WestEnd Flamingo before the sixth (6th) week of the Course that you do not wish a Student to be re-enrolled onto the following Term of the Course, then you will remain liable for half of the full Term fees in respect of the next Term, regardless of attendance of the Student.
 

4.6 Payment is due for the next Term of Course fees before the start date of the Term, subject to any alternative payment agreements you may have with the Principal.

5. COURSE TRIAL PERIODS
 

5.1 Where a new Student is attending a Course for the first time, subject to availability, WestEnd Flamingo allows a one (1) trial session ("Trial Session") so that the Student may try the first one (1) session of the Course. The Trial Period only applies to Courses for new Students and the one (1) trial session must be taken within the first two (2) weeks of the start of the Term.
 

6. WORKSHOPS & HOLIDAY WORKSHOPS/CAMPS
 

6.1 Parents should contact their local WestEnd Flamingo school to confirm if it is organising Workshops and/or Holiday Workshops/Camps.
 

6.2 Dates and times of Workshops and Holiday Workshops/Camps are released in advance on your school website where WestEnd Flamingo classes and workshops take place.
 

6.3 For the avoidance of doubt, the Trial Period and sibling discounts detailed in sections 5 and 4 above do not apply to Workshops or Holiday Workshops/Camps.

 

7. USE OF PERSONAL INFORMATION
 

7.1 The personal data (as it is defined in the Data Protection Act 2018) of a Student and/or Parent will be processed by WestEnd Flamingo, including any group companies and/or the Principal(s) in accordance with its Privacy Policy, which can be found here Privacy Policy.
 

7.2 WestEnd Flamingo owns all the rights, title and interest in and to its websites, including software, text and media and its trade marks, logos and brand elements. Nothing within these Terms & Conditions affects or licences the ownership of these rights. Any intellectual property created during any Course, Workshop or Holiday Workshop/Camp is owned by WestEnd Flamingo.

 

8. HEALTH AND SAFETY
 

8.1 Students participate at their own risk and are obliged to inform WestEnd Flamingo and its staff of any existing injuries or medical condition. All application forms must have any known medical conditions stated and any changes to such information must be notified to WestEnd Flamingo immediately in writing.
 

8.2 If you are unsure whether a Student should participate in any activity please consult the Student's GP before enrolling the Student on a WestEnd Flamingo Activity.
 

8.3 Any medication left on the school premises must be clearly labelled and the Student should, unless WestEnd Flamingo has agreed in writing otherwise, be able to administer it themselves.
 

8.4 Students must wear suitable footwear and clothing at all times, including WestEnd Flamingo uniform for all Courses.
 

8.5 If a Student is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the emergency contact details provided below or on the enrolment form. This number must always be contactable whilst the Student is attending the WestEnd Flamingo Activity.
 


8.6 Parents are solely responsible for ensuring that the emergency contact details on WestEnd Flamingo's records are up to date.

8.7 All online activities are recorded and held for a period of four weeks for safeguarding and quality review purposes.
 

9. PERSONAL PROPERTY
 

9.1 Students are obliged to take care of their own belongings. WestEnd Flamingo can accept no liability for lost or damaged belongings.
 

9.2 You acknowledge that the maximum aggregate liability of WestEnd Flamingo to a Student or Parent under these Terms & Conditions shall not exceed the WestEnd Flamingo Activity fee to which a claim relates.
 

9.3 The liability of WestEnd Flamingo and that of its staff is restricted to class time only and then only to gross negligence.

 

10. GENERAL
 

10.1 WestEnd Flamingo may, at its own discretion, refuse a Student entry to a WestEnd Flamingo Activity or session of a WestEnd Flamingo Activity if it is felt that the Student's behaviour is unacceptable
 

10.2 WestEnd Flamingo reserves the right to make changes to the timetable, the teaching staff,  the advertised programme or the programme delivery mechanism (for clarity this may mean that we switch to online zoom classes) in the event of illness or other circumstances beyond our control.
 

10.3 Where a session of a WestEnd Flamingo Activity has to be cancelled by WestEnd Flamingo, Principals will give as much notice as possible. In the event of a last minute session cancellation, you will be notified by email, text message, a call to your mobile phone or through a designated WestEnd Flamingo social media site. Parents must ensure that they provide their Principal with up-to-date contact details.

In the event of a WestEnd Flamingo Activity being cancelled, WestEnd Flamingo will provide substitute lessons where possible either at an alternative time, venue or online.  If no alternative can be offered, WestEnd Flamingo will provide refunds for lessons that are unable to be fulfilled.
 

10.4 It is occasionally necessary to change the time and/or venue of a WestEnd Flamingo Activity session. This will only be done if absolutely necessary and WestEnd Flamingo will do its best to keep class times, programme delivery mechanisms and/or locations as similar as possible but unfortunately this cannot always be guaranteed.
 

10.5 In the event that a Student is unable to attend a WestEnd Flamingo Activity session, due to sickness, holiday or a decision by the Parent or Student not to attend, WestEnd Flamingo regrets that it is unable to refund any payment.
 

10.6 All Students must be collected on time after a session. WestEnd Flamingo is unable to supervise Students after a session and consistent late collection will result in additional charges.
 

10.7 WestEnd Flamingo Activity fees are reviewed annually and may be increased each year. Fees are sometimes subject to change at the beginning of the academic year.
 

10.8 These Terms & Conditions, together with any Fee Note or Acceptance Letter, constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
 

10.9 In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.
 

10.10  The Agreement shall be governed by, and construed in accordance with, the laws of England and Wales and any dispute, proceedings or claim shall fall within the jurisdiction of the English courts.​​

11. RETURN & REFUND POLICY

11.1 Classes - If a student is accepted, WestEnd Flamingo does not give refunds or credits for missed classes or cancellations.

​

11.2 Clothing/Shoes - WestEnd Flamingo does not give refunds or credits for clothing or shoes, though we are very happy to exchange your item within 10 days as long as it is in good condition, fault free and undamaged. If you wish to exchange Goods to WestEnd Flamingo for any reason, please contact us using the details on the contact page to make the appropriate arrangements or let your child's tutor know.

 

11.3 Exchanges are valid as long as item/s meet ALL our requirements:

  • WestEnd Flamingo operates a 10-day exchange policy (including bank holidays and weekends)

  • Goods must be exchanged within 10 days of purchase/delivery

  • All items must be unworn & in unused condition with the original swing tag still firmly attached in original packaging, odour free, unstained, no marks. Please take care when trying the goods on. If the tag is removed, no exchange can be made

  • State your reason for returning the item

  • If you do not have an invoice within your parcel please email hi@WestEndFlamingo.com and we will send you another

12. UNIFORM

 

  • Pupils should attend class with the correct uniform. Our uniform can be purchased at our online shop.

  • Girls: Hair is to be in a classical ballet bun or neat pony tail. Children will not be allowed to dance with their hair down, incorrect uniform or inappropriate footwear. Please understand this is for your child's own safety.

  • WestEnd Flamingo or its employees/contractors/helpers can accept no liability for lost or damaged belongings.

 

13. TIMETABLE

 

  • WestEnd Flamingo reserves the right to make cancel or reschedule classes and to the teaching faculty at any time.

14. PARENTS RESPONSIBILITIES

 

  • Please ensure your child is booked into the correct age group.

  • To make sure all contact details are up to date by completing the online registration form before you book with WestEnd Flamingo. Please provide more than one contact number in the unlikely case of an accident.

  • If a student is required to take medication whilst participating in class, parents/carers should take full responsibility and ensure teaching staff are properly informed.

  • To ensure staff are aware of any existing injuries, medical condition and any learning difficulties that may need special attention. WestEnd Flamingo or its employees/contractors/helpers are not held liable for injury or health risk sustained in any classes.

  • I hereby give WestEnd Flamingo permission for my child in my absence to be given emergency medical treatment if deemed appropriate.

  • Please ensure your child has been to the toilet before class to avoid accidents and disruption.

  • Please ensure that all children are collected on time at the end of their class by a parent or carer. Please notify the teacher at the start of the class if someone else will be collecting your child.

15. PHOTOGRAPHY AND VIDEOGRAPHY

For promotional purposes, WestEnd Flamingo takes photographs and recordings of our classes, workshops, parties and any other events we hold. By agreeing to these Terms & Conditions you allow recordings and pictures to be taken of your child for promotional purposes by WestEnd Flamingo.​ Kindly contact us by email info@WestEndFlamingo.com if you wish for your child to be excluded from this.
